1. Acceptance of Terms

By accessing or using the TakeControl app or any of its digital services (collectively, the “Service”), you confirm that you have read, understood, and agree to these Terms of Use (“Terms”). If you do not agree with any provision, do not use the Service.

These Terms constitute a binding agreement between you and TakeControl App.

2. About TakeControl

TakeControl is an expense-splitting and group expense management app, available for free download on iOS (App Store) and Android (Google Play). Additional features are available through a PRO plan subscription.

3. Eligibility and Account

3.1 Minimum age

You must be at least 13 years old to use the Service. By creating an account, you confirm that you meet this requirement. In Brazil, the minimum age is 14, in accordance with the Brazilian Child and Adolescent Act and the LGPD (art. 14).

3.2 Registration

To access certain features, you will need to create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity carried out under your account.

3.3 Accuracy of information

You agree to provide truthful, complete and up-to-date information when creating and maintaining your account. Registering with false information may result in the immediate termination of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. The following are expressly prohibited:

  • Violating any applicable law or regulation;
  • Attempting to gain unauthorised access to the Service’s systems or data;
  • Reverse engineering, decompiling or disassembling any part of the Service;
  • Transmitting viruses, malware or any malicious code;
  • Using the Service to send unsolicited communications (spam);
  • Collecting or processing other users’ data without consent;
  • Using the Service in a way that could harm its availability or performance;
  • Committing fraud, impersonating third parties or falsifying information.

TakeControl reserves the right to suspend or terminate accounts that violate these rules.

5. PRO Plan and Payments

5.1 PRO features

The PRO plan offers additional features, including voice logging, currency conversion and receipt scanning. The full list of features is available in the app and on our website.

5.2 Subscription and billing

The PRO plan is sold exclusively through the App Store (Apple) and Google Play (Google). Pricing, billing terms, auto-renewal and cancellation are governed by each platform’s policies.

5.3 Refunds

Refund requests must be made directly to the App Store or Google Play under their respective policies. We do not process refunds directly, except where required by applicable consumer protection law.

6. Intellectual Property

6.1 TakeControl’s ownership

All Service content — including brand, logo, design, interface, source code, animations and text — is the exclusive property of TakeControl App and is protected by applicable intellectual property laws.

6.2 Your data

You retain ownership of all data you enter into the Service (expenses, groups, notes). By using the Service, you grant us a limited, non-exclusive, revocable licence to process that data solely for the purpose of providing the Service.

7. Privacy and Data Protection

The processing of your personal data is governed by our Privacy Policy, which has been drafted in compliance with the Brazilian General Data Protection Law (LGPD) and the EU General Data Protection Regulation (GDPR). That Policy forms an integral part of these Terms.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TakeControl will not be liable for any indirect, incidental, special, consequential or punitive damages, including data loss, loss of revenue or business interruption.

Our total liability, for any reason, will not exceed the amount you paid for the Service in the 12 months prior to the event giving rise to the claim, or USD 10.00, whichever is greater.

This limitation does not affect consumer rights guaranteed by applicable law.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free or that it will meet your specific expectations.

10. Modifications to Terms

We may revise these Terms from time to time. For material changes, we will notify you by email or in-app notice at least 30 days in advance. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

11. Termination

11.1 By you

You may close your account at any time, directly through the app or by sending a request to [email protected]. After closure, your data will be handled as described in our Privacy Policy.

11.2 By us

We may suspend or terminate your account for violations of these Terms, with prior notice where possible. For serious violations, suspension may be immediate.

12. General Provisions

  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • Failure to exercise any right under these Terms does not constitute a waiver of that right.
  • These Terms represent the entire agreement between you and TakeControl with respect to the Service.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Users located in the European Union retain any rights granted by mandatory local consumer protection law that cannot be waived by contract.
